Looking for some clarificiation, whe currently have a wheelset frame 2.5 T that has forklift pockets, is there a legal requirement to have to have this statutory, and what will this ideally fall under  LOLER - Regulation 8(2) of LOLER defines a lifting operation as 'an operation concerned with the lifting or lowering of a load'

or PUWER Work equipment

Is a wheelset lifting frame the same as a wheelset stacking frame? 

If it is do you actualy use a fork lift to lift it while loaded with wheels? Id so i would think the frame is classed as a lifting accessory and so would need examining at the same time as the FLT. If the pockets are simply used for moving the "empty frame  into position - or stacking a number of frames on top of each other then for me its a load.  But having just typed that im thinking - what is the difference between teh frame and a pallet - so i think i have talked myself into "i dont know" as an answer.

Will be interested to see what others think.

Depends on what you risk assess with regards to lifting plans etc as that can depend on what you are doing (See below link). Anything lifting, requires a LOLER inspection. My interpretation is that anything not lifting people (Ie a fork lift) should be 12monthly. If lifting people then 6montly and more frequent depending on use (Recommended/Guidance).

I would also say it would come under PUWER (Following manufact guidelines, General inspection etc)

MD - where does the 2.5 tonnes come from?

Is this the weight of the frame itself or the load it is designed to be capable of safely carrying. If the latter, then presumably the 2.5 tonnes is likely to be the defined safe working load of what is to be carried or frame + what is to be carried. Thence, likely to fall with the definition of a lifting accessory, subject to LOLER.

If reasonably new, then the documentation with it should help you determine whether to apply PUWER or PUWER + LOLER.
