Hi I work for a company that carry out Social housing maintenance and repair works for a number of local authorities. Prior to works we always request copies of Asbestos surveys. Some clients provide this and some clients are unable to provide this information so we make the arrangements on their behalf the for an asbestos survey to be carried out to ensure we have folowed due dilligence before sending our contractors in to complete any works.

The question I have relates to newer buildings and if there is any legal H&S requirements to complete Asbestos surveys for buildings made after 2000 that are not on Brownfield sites.

I can understand that some buildings made soon after the use of Asbestos was banned in 1999 may still have asbestos products used in them due to stock materials which would still have been available but would be interested to get other views and experiences on this. 

Any input advice would be gratefully received.

You're correct in your assessment, it is reasonable to presume that builds after 2000 are free from asbestos with the exception of brownfields sites. 

Unless there is any reason for you to suspect otherwise you have considered the risk of asbestos for the site, docuement that the site is deemed to be asbestos free until there is any cause to alter this.

The HSE States:

"You know for sure the building was built in or after 2000

It is unlikely to have any asbestos.

However see information on brownfield sites and old equipment below. If either of these is applicable you should continue. The guidelines for these are later in the scheme.

If neither of these apply you have completed the scheme and do not need to continue. Print this page and keep it for your records."

Hi Simon - the ban that came into force on 31 December 1999 was announced a long time before.

So, other than the proverbial "cowboy builder" no contractor should still have been putting Asbestos Containing Materials into new builds in 1999, let alone later.

My starting point would be to ask for the CDM Health and Safety File(s).

If a building completed after 31 December 1999 doesn't come complete with at least one Health and Safety File [INCLUDING documentation that you can do an audit trail back to initial completion], it is time to ask more questions!
