Cutting a live gas pipe - Reported under GSMR, Do I need to RIDDOR aswell?

Morning all I need a bit of advice please, on our project we cut into a gas service pipe that we had been told was dead (but we failed to check!), turns out it was still live and the gas company called to make it safe. Ive sinced found out that the gas compnay have reported the incident to HSE as they have calculated that more than 10kg of gas was released inside a building (same wording as RIDDOR Dangerous Occurences)
My question is will HSE still expect a RIDDOR report from us as principal contractor to inform them of the same info they have received from the gas company under GSMR? my concern is that the gas company took so long to finally confirm how much gas was released that I am now well passed the 10 day window to report under RIDDOR therefore we are probbaly in more trouble for not reporting it!

Hi Ray Different regulatory requirements, different duty holder. So, ignore GSMR (I would actually have to look up what those Regs say!) and stick to RIDDOR. On the basis of your narrative it falls within scope of paragraph 26 of Schedule 2 Part 2 and hence is a "dangerous occurrence" and reportable under Regulation 7 of RIDDOR.
Which then takes you back to the "responsible person" who is very unlikely to be the gas transmission company, and if your organisation was in control of the premises at the time, then it's your job to report whether or not it has been communicated to HSE by A N Other.
You can explain any delay in reporting and a late report is a much less serious offence than NO report!

Thanks Peter my gut feeling is yes we need to RIDDOR report it so thanks for confirming this, we were indeed in control of the premises at the time as we were PC on the project. your also right, a late RIDDOR report is far better than no RIDDOR report!
