Guys, Did you having bad experiance with your manager or Engineer ? If some safety observations coming, senior team clean off their hands by simply putting names of new guys or less experiance team members under them . I am suggesting to our senior team members in our forum to support atleast give advise to tackle the situations . They are the future of the company otherwise they will repeat the same. Afterall we need a positive HSE Culture in our companies

To check I've understood your situation, is it this? Your company has a process for raising safety observations which need to have actions taken on them, and the actions are being assigned to junior staff, instead of the team leaders taking responsibility?

Hi Sonu If Kate's interpretation of your question is correct, then I think that it is entirely appropriate for senior managers to delegate SOME but not ALL of the actions to be taken following an Observation report. Somebody needs to look at each Observation and decide as to the depth of response. So, suppose you get a report of a trip hazard, you delegate somebody to sort it out. Suppose you get 20 reports of trip and slip hazards, somebody more senior needs to take ownership of WHY this is happening, whilst at the same time delegating people to sort out each hazard.

Authority to undertake tasks can always be delegated but should never be confused with the senior manager Responsibility to ensure the appropriate task has been completed in a timely and satisfactory manner.

Issue some training to the managers in relation to the Corporate Manslaughter Regulations : Corporate Manslaughter and Corporate Homicide Act 2007 (legislation.gov.uk) They are able to pass on their workload, but they aren't able to pass on their responsibility. If they're attitude results in negligence, then they are responsbile. Even if they passed the work onto a junior member of the team.

I suggest referrring senior managers to the Corporate Manslaughter etc Act is almost pointless given that it has been used in Court extremely rarely, so is not much of a stick with which to beat the managers. ....and the larger the organisation the less is it is likely to be relevant. ....whereas in a very small organisation, it should usually be relatively easy to pin any death on one or more bosses, so as to enable a prosecution via individual manslaughter. Carrots are much more likely to get effective change.
