Hi, Has anyone got any advice on the following:

We had a third party fire risk assessment conducted in December 2023, we are now being advised that we need a new assessment, is this the case?

Section 156 of the Building Safety Act 2022 (BSA) makes a number of amendments to the Regulatory Reform (Fire Safety) Order 2005 (FSO) to improve fire safety in all buildings regulated by the FSO. These improvements form Phase 3 of the Home Office’s fire safety reform programme, building on Phase 1 (the Fire Safety Act 2021) and Phase 2 (the Fire Safety (England) Regulations 2022).

Phase 3 further strengthens fire safety in all FSO regulated premises by:

  • improving cooperation and coordination between Responsible Persons (RPs)
  • increasing requirements in relation to the recording and sharing of fire safety information thus creating a continual record throughout a building’s lifespan
  • making it easier for enforcement authorities to take action against non-compliance
  • ensuring residents have access to comprehensive information about fire safety in their building

The changes to the Fire Safety Order have not yet been implemented but will come into force later.

It would make sense to check you comply with the strengthened requirements but you don't necessarily need a new fire risk assessment.

Will this provider of the FRA (carried out in Dec ’23) be providing you with a free update or will they be charging you for the privilege. Will they charge you the standard amount for a new assessment or will it be charged per word amended( which should be very little)?

AK what would you suggest the standard amount for a FRA.

The issue is not whether a good FRA, from a competent assessor,  is worth the money but they way that the assessor has told the client that they need a “new” FRA , right now. It sounds a bit predatory. As people have mentioned it is not clear  whether a new  FRA is needed and if any changes are essentially cosmetic.
