Hi all Happy Friday A quick question which I will try and keep simple A contractor wants to give out some work that they will potentially be doing for us to another contractor ( effectivley sub contracting) After making some enquiries it appears that there is no formal contract between to 2 other than the first contrator has an account with the 2nd contractor. Am I over thinking it or do they have to have something more formal between them? My concern is if something goes wrong or we need to get them back for any reason there would be no direct link between us and the 2n contractor I hope that makes sense??

There is nothing to stop them sub-contracting work however if they have an intention to do so they should have arrangements in place for the control of sub-contractors including for example:
Making sure the subby has liability insurance of equal or better value to that being offered by your contractor. They should be reviewing the subbies RAMS etc. to make sure they match with what they have supplied you. If the subby is suitable why not go direct and cut out someones mark-up?

People need to remember that a contract is NOT a document. It is an agreement between two or more people to do something in exchange for a consideration (typically money). The formal document that is associated with a contract is simply a description of the terms of the contract. Your contract with the contractor should have included something about sub-contracting: when is it acceptable and what do expect the subbies to provide eg insurance cover vis a vis Roundtuit’s comments.
