Hi All, just after some help regarding who should be in control of drainage system for a business premises owned by landlord. This is so I can ensure we have done everything as a company to follow enviromental guidance regarding trade effluent process. TIA

Which type of drainage - surface water (road / car-park run-off) or foul sewer (toilets etc.)? These would normally come under the premises occupier and should be identified in the rental agreement as to who is responsible for arranging maintenance and payment of fees and charges. For an ISO 14001 system it can get tricky when it is a site of mutiple occupation by several businesses e.g. writing control procedures to prevent spillages entering surface water drainage. We had an "office" company based at one of our sites and found their MD regularly having his car washed in the car park with the run-off entering the surface water drainage contrary to the sites permitted consent. Trade Effluent (your title) is wholly different and as it occurs due to a process or activity being undertaken the business would be wholly responsible (polluter pays principal).
