Morning all,

Is it a legal requirement to retro fit safety devices if a roller shutter was manufactured and installed prior to the changes as, under grandfather rights, you only need to install as when new and to the current standard.

I assume (dangerouse i know as that makes an ass out of u and me!) that this is what you are talking about

Revision of Standards for Powered Doors, Gates and Barriers (hse.gov.uk)

which states: 

  • Although these standards are not intended for retrospective application, many existing powered doors, gates and barriers may not be as safe as they should be (some did not meet the previous standards or requirements for safety when originally supplied), so they can be used to support the re-assessment and any necessary upgrades to make existing products safer for continued use.

I do sometimes wonder why people look for an ansolute legal requirement for makeing something which is intrinsicaly unsafe - safe (or at teh very least safer). If an inspector thought your door were unsafe they could i serve a prohibition notice on it in even if it was within guidance when fit.

Thanks for you response Brian. Your comments regarding an inspectors thoughts reflect my own. I will review the risk assessments and ascertian the requirements to make them safer.
