Hi all,
Is a HAVS diagnosis ever not a riddor?
For example if an individual is not part of health surveillance as he is well below the EAV (let’s say 10 points per day) and isn’t a regular user of vibratory equipment. (Infrequent)
Outside of work he may do lots of DIY is his spare time and has subsequently received a ‘home diagnosis’ of HAVS.
I know the HSE say that if you’re unsure about it being work related report it anyway but has anyone been in a situation where they haven’t - and where are the lines drawn?

So the bit in reg 8 that states “if regular use of vibratory or percussive tools at work” is irrelevant then?
If he uses vibratory tools infrequently at work then it’s still reportable because it’s a diagnosis? I personally think it’s a little bit misleading and could lead to some organisations underreporting.
I spoke to the HSE and they said if you’re unsure then report it id like to know in what cases I would be sure it’s not work related (so it’s possibly not reportable). I understand the point being guided by doctors advice but is it really always black and white ie) diagnosis always reportable irrelevant of low points and not regular. Seems so.

no it isn't but it does depend on what the person told thier doctor...and there are other things like Ranauds that present like HAVS...if it says work related on the report then you must report...you can challenge that but I am suspecting as the person is not part of a health surviellence you won't have the existing system to prove otherwise...you will need to get him checked out by your own Doctor and independantly disgnosed

im with Steve on this one - to not report you will need good evidance that it cannot be work related. I would also get him HAVs assessed so even if it is home caused you can demonstrate you are taking reasonable care - happy to be corrected but could be an equality issue in future.

regular "arranged in or constituting a constant or definite pattern, especially with the same space between individual instances" so once per year can be regular.
