Afternoon all,

my site had a bad accident last friday involving an FLT and a pedestrian, the person is on the mend and wants to come back to work ASAP, they can complete there normal duties as its office based.

The accident was last Friday 12th, taken to A&E and advised to keep there leg moving to keep blood flow to help heal the injury and badages changed regular. 

The IP said they will return to work this friday 18th (6 days exluding the day of accident) however they have now contacted there manager and said they have Monday booked as annual leave could they have Friday aswell for a long weekend, not to help the healing process, we only work half days friday! 

So the question is would this now be reportable?

The criterion is not whether they are at work, but whether they are fit to do their normal work.  Being on leave is irrelevant to fitness (except in that it may make it harder to determine whether they really are fit for work).

If the IP was due back on Friday and was fit to do all his normal duties it would not be reportable. Taking annual leave doesn't make him suddenly unfit to do his duties, so not reportable. I would ensure you have a good record of his request for leave coming after he said he was fit to return to normal duties just in case a lawyer decides to put another spin on what has happened.
