Can the Responsible Person of a building which has shared occupancy nominate personnel from companies other than their own to be a fire marshal?  If so, is the nominated person within their rights to decline the role of  responsibility?  Thanks

No you cannot nominate people who are not your direct employees.

You can (in consultation with their employer) invite volunteers from businesses within a shared environment.

Either way (employee or volunteer) they retain the right to withdraw their personal service.

Yes, the Responsible Person (RP) of a building with shared occupancy can nominate personnel from companies other than their own to act as a fire marshal or fire safety representative. The RP has a duty to ensure that adequate fire safety arrangements are in place, which can include designating fire marshals or similar roles.
