Posted By Bob Randall I am trying to find the legislation that makes it a requirement for the Local authority Fire Brigades in Scotland to issue a fire certificate for a building used as a house in multiple occupation. In England and Wales there is the Fire Precautions (Hotels and Boarding Houses) Order 1972 which makes a place where sleeping accomodation for "six or more staff or guests" is provided a designated place in terms of the Fire Precautions Act 1971. The Fire Brigades seem to be using the terms of this order (even though it specifically excludes Scotland) to in some cases require the issue of a Fire certificate and in some other cases to interpret the order very narrowly in that they say the Order only requires us to issue a Certificate if the premises are used for "providing, in the course of carrying on the business of a hotel or boarding house keeper, sleeping accommodation for staff or sleeping, dining-room, drawing-room, ball-room or other accommodation for guests". Now a HMO is not strictly speaking a hotel or a hostel or boarding house and some are run not for profit but as a service to certain vulnerable members of the community but it certainly does provide sleeping accomodation for staff and residents. My questions are: - Does anybody know of a similar order applying to Scotland? How is the Order interpreted by Fire Brigades in other parts of the country? Bob R
