Hi,
I am aware that HSE legislation is appropriate only in the EU. What precautions should an EU company take with regard to working at height when sending employees to America, for example? Would the regulations still be relevant as we're an English company?
Sorry, sill question and I know I should know the answer!

Whenever you are working abroad, the local health and safety legislation is the minimum standard you should be working to. However, within the EU if you adopt the same standard as the Uk you are unlikely to be a million miles away from compliance, although it will not guarantee compliance as there are clearly some differences in regulations in general terms as well as interpretaion of EU directives.
Outside the EU it is somewhat more tricky and you will need to establish the relevant local legislative standards and comply with them.
However, any responsible UK company should be adopting the higher of two (UK or local) standards as a minimum and should ideally be looking for a best practice approach that exceeds both UK and local requirements (although other factors need to be considered when doing this)

Ok, next question is (somewhat predictable), how do I go about establishing U.S. working at height regulations that may be applicable?

A good place to start for US law on safety is the Occupational Safety and Health Administration, OSHA for short, which is at
http://www.osha.gov/
There is an A-Z index, which has a section on fall protection.

Generally the rule of thumb adopted by most responsible british companies and Government Departments (e.g. MoD)operating overseas is;
Use UK H&S procedures unless the country your working in has a higher level of compliance, in which case adopt the country's procedures.
The only exception I know to this rule in the UK is the American Forces, who by agreement operate to the USA H&S standards !!
