My company is moving a department temporarily into an unused building on our site. there are 15 people in the dept. The area has a set of male toilets but no female toilets. Is there a legal requirement to have separate male/female toilets. the department are happy to use the facilities as they are. The building will be demolished in less than a year so big spending is out. Anyone know the answer to this please?

the answer is in the 'Workplace Health Safety and Welfare Regulations 1992' Regulation 20 sanitary conveniences. in short fit a lock on the inside and its OK.

As previous, workplace regs 92 as long as you are able to lock the door its ok......... though a word of caution, set the standard of cleanliness, it may sound trivial but it can be a potenial disagreement between male / female... but how its policed god knows???

Presumably the female toilets exist elsewhere on the site? They don't have to be provided in every satellite building!

Toilets can only be used by both sexes if the cubicle walls reach the floor and the ceiling.

If you've consulted with both parties that is the main problem over - you don't say if urinals are present or just WC's? I know in the CHSWRegs it reads that so long as the toilet can be locked for privacy and there is not the embarassment of urinals it's OK on construction sites. (words to that effect anyway)
I would ensure that there is plenty of air-freshener available!!
Don't forget the Sani-units, they do on the construction sites!!

I can't remember where i read that exactly as it was some time ago but the workplace regs alude to it.
'20(c) Separate rooms containg conveniences are provided for men and women'-This is the normal male and female toilets.
'except where and so far as each convenience is in a separate room the door of which is capable of being secured from the inside' - This aludes to a unisex toilet like a disabled toilet as it says 'each convenience' meaning 1 convenience in the room, the word 'seperate room' is used which shouldn't be confused with a cubicle, as a cubicle could never be called a room.
Hope this is clear, i have a feeling it isn't though
