No, we would like to have a training session about 1-2 hours just to get the management into the feel of a court room if a inspector ever did prosecute to hit home fist

Why not spend your training budget on pro-active H&S management training instead?

Nothing can prepare you for the feeling surrounding court room action.

However, my local IOSH branch have recreated this type of situation to provide members with an understanding of the HSE protocols that may be followed during their investigations and subsequent enforcement action.

Having spent 5days in the witness box at the Old Bailey it is no fun beleive me, there is a course run by a solicitor on this, I will try to find his name and address and put in on the site

Good idea to provide some training - I have previously commissioned witness skills sessions from a firm called Bond Solon in London - very professional and a good way to achieve improvements in management co-operation and the quality of reporting.

Google Bond Solon and I'm sure their site will come up.

Some years ago a group of us got together and organised a course by Bond Solon on expert reports and courtroom skills. I have to say it was excellent and gave me much more confidence that I could handle these two aspects of my work.

In fact, most civil actions never end up in court but are settled outside the courtoom. Criminal actions are, of course, a different matter.

Having said this, the need for an expert witness report or courtroom attendance is, in my view, an indication of a failure. I would be more concerned to ensure that when the inspector calls there is nothing he finds that warrants more than a word or two of advice, or at most an Improvement Notice. In my experience (and with minor exceptions) inspectors tend to avoid bringing charges if at all possible. Provided the company has a policy of active risk management and is trying to get it right, my experience has been that they will generally tend to be supportive.

Hello;


After spending over 30 years working with the Occupational Safety and Health Administration (OSHA), both as a compliance officer and a consultant. I believe I can answer that question.

I recently retired, and now provide my services (safety and health) as a private consultant.

One of the main reasons why citations are issued, penalties are assessed, is the fact that the visit was not handled properly.

There are three parts of a visit (OSHA).

Opening conference
Walk around inspections, and
Closing conference.

The most important one out of those three, is the opening conference.

This is where the stage is set, and can determine the outcome.

It is very important, to know:

Who should attend the opening conference.
What material should be provided, and
What questions should be asked, or answered.



I provide a list of services, one being education and training, and talks on how to handle and prepare for an OSHA visit.
