Posted By Bill Bircham Hi All, Can anyone help? I'm looking for examples of enforcement action by the HSE where a Local Authority was prosecuted over the H&S failings of one of its' contractors. In particular where either housing maintenance or waste industry activities were going on. No mischief making behind this, and no-one will be named and shamed, but need to do some research to prove a point, Thanks in anticipation of loads of responses . . ! Bill

Posted By Bill Bircham John, Thanks, but this seems to be a list of 'others'. What I'm after is cases where the Local Authority itself is the Defendant and was subsequently found guilty on charges which relate to the lack of management if its contractors. Rgds Bill

Posted By David A Cooper I recall a case on the Isle of Wight where I believe the local authority were prosecuted following an electrocution in a public toilet. If I remember correctly the stainless steel components hadnt been bonded to earth.

Posted By Adam Hammerton Bill, I was looking for the exact same info recently and could find very little. If you search the HSE prosecution database for breaches and use "council" "hasawa" section "3" and "contractor" in case details as criteria it will give you a few (mainly asbestos related) but they are more to do with the councils failure rather than the failures of the contractor.
