Hi All,
Can anyone help? I'm looking for examples of enforcement action by the HSE where a Local Authority was prosecuted over the H&S failings of one of its' contractors. In particular where either housing maintenance or waste industry activities were going on.
No mischief making behind this, and no-one will be named and shamed, but need to do some research to prove a point,

Thanks, but this seems to be a list of 'others'. What I'm after is cases where the Local Authority itself is the Defendant and was subsequently found guilty on charges which relate to the lack of management if its contractors.

If you search the HSE prosecutions database for CDM prosecutions you will find virtually no cases involving LA clients.

I recall a case on the Isle of Wight where I believe the local authority were prosecuted following an electrocution in a public toilet. If I remember correctly the stainless steel components hadnt been bonded to earth.

Use the advanced search option in the HSE Prosecutions database
Select cases
Select defendents name
Type council
you are likely to get some 80 plus results of prosecutions of local authorities--the search can be refined.

Hi Bill,
I just tried searching the Prosecutions Database using "Council" as part of the defendant's name. It's a bit tedious to pick through them all but there are a few gems amongst the dross.

Bill,
I was looking for the exact same info recently and could find very little. If you search the HSE prosecution database for breaches and use "council" "hasawa" section "3" and "contractor" in case details as criteria it will give you a few (mainly asbestos related) but they are more to do with the councils failure rather than the failures of the contractor.
There is one case though that fitted for me, although not a great example.
