The common ground here is that we dont dig trenches near temporary structures i.e. near erected scaffolding. is there a minimum distance away from the temp structure we can dig our trench and can this be located in writing.

No.
Depends on ground conditions - type of soil/rock, water content, cohesiveness of soil, its bearing capacity etc etc...
Also depends on the size and extent of the temporary structure, and what loading is being transferred to the ground.
Other factors for consideration include the proximity of vehicles and heavy plant which may affect the excavation.
Not the answer you are looking for, but its down to risk assessment!
