Quick question - who should report an accident at work (construction) - main contractor or sub-contractor? being told to "let the sub-contractor report it."

The employer Jonf, whoever that is, with the full knowledge of the PC, if it is a SC to the PC.

Further thought - would WE(PC)be advised to carry out an accident investigation (potential future claimes etc). Maybe too late now however.

CFT - PC is in control - it is his site - why not they report?
It might help better identification of PCs that employ SCs that do not comply with minimum standards?
Just my thoughts?

had this one a couple of years ago but if I remember rightly the safety advisor of one of our subbies wanted us to report an accident to one of his employees because the ACOP for RIDDOR says something like, "the person in charge of the site" must report it.
However when I rang the guys in Wales to ask them direct they said and again I paraphrase, that its the guys who pay the wages who report.
I challenged them and said that we paid the subby so isnt it still us and the answer was a categorical NO.
So its your subby who reports

Hello Jonf,
Before I start I must add I haven't got any constuction experience but:
My brother was injured at work, not only was RIDDOR not used, but the PUWER regs had also been breached, resulting in his injury.
When I sought advise on his behalf, I was advised that either the person ultimately responsible for that person should report, or which isn't a good option, the injured party can report it himself after ten days using the F2508.
I would seek advise via the HSE web as in the past they have been very helpful with myself.

CFT is correct that where the injured person(IP) is an employee then his employer should report the injury. (This aspect has nothing to do with it being a construction site)
In addition, on a construction project, the Construction (Design and Management) Regs require the contractor (employer) to notify the Principal Contractor of all injuries reportable to the HSE. The PC being in overall control of safety can then investigate and if necessary amend his arrangements for managing safety.
There is a requirement for the person in charge of the premises to report incidents/ injuries to the HSE but only if
a)The injured person is not an employee (e.g.member of public) or is a self employed person with no one else in his organisation who can report it. OR
b) the incident is a defined Dangerous Occurrence
