Talk about pot kettle black! At my local fast food chain same as the one named in the article, they have employees waiting at the end window chatting to the employees inside, this giving a high risk of them being hit my vehicles using the drive through.

Seems acceptable, you wouldn't go thorough the drive through on a normal bike so why go thought on a tandem. The chap even states 'We just decided to try our luck" that says to me it was just done to entice a reaction, and they didn't even expect to get served.

I would consider that mcdonalds took the wrong action and it would have been OK to let them through.
For me its just another example of H&S in lala land.

I know it’s not Friday today but I can’t resist a frivolous comment about the hypothetical mum mentioned by Crim: In veterinary and farming parlance, it would seem that she had already been “served” – some 9 months before her bairn was born!
Hope this observation doesn’t overstep the threshold setting of any moderatorial smutometer. If so, I would advise that years ago the BBC would have regularly triggered smutometers with its TV comedy series “Are you being served”. Each episode was packed with double entendres, never mind the title one. Awareness of the series seems to have been revived by the recent death of actress Mollie Sugden who achieved fame as its formidable Mrs Slocombe.

This has more to do with insurance and liability than health and safety.
Health and safety is always used as an excuse why things can't be done.

That's one confused Restaurant Manager!
'It's a general health and safety policy in case they are hit by cars.'
'To be honest if I'd have been working that shift I would have probably served them but advised them it was at their own risk.
'After 11pm, we only open the drive-thru and in my opinion if somebody wants to be served at the window they do so at their own risk. Common sense should prevail.'
H&S Policy, discretion, 'own risk' and common sense prevailing - all neatly wrapped into one argument! Sounds like a job for the RSES to sort out!
