It's a difficult area really.
Should the judge initiate the shutdown of the plant that has an impact on the actual people that should be protected or propose another system?
IMHO I'd be looking at a phased system such as related over the next 5 years and be profit related with UK coal showing what they have contributed to increase H&S and possibly the local community?
There is a fine balance here between closing down & ruining people lives and punishing by other means over time?

Agreed, it is a very difficult and contentious matter, exacerbated by using mainly pecuniary sanctions. It is my personal view that if an organisation is so poorly managed it should be faced with closure. Judging from the losses UK Coal have made in recent years it looks like they are on their last legs anyway.
Rather than a fine it makes sense for the judge to award compensation to the bereaved dependants. The court can also impose a remedial order on the company in liaison with the regulating authorities to improve its safety systems and practices; and where applicable sanctions should be taken against directors/ senior managers ie s37 and Director Disqualification - that would send out the appropriate message.
