During a CDM notifiable factory refit I had one incident where I had to stop an electrician who was driving a scissor lift whilst using the phone. We had already banned the use of mobile phones except during breaks so not only was he breaking the rule but he was doing in a hazardous situation.
Speaking to another construction worker he said that on some sites they were allowed to use phones but they had to move to a position where their back was to a wall before taking the call.

Not aware of any case law involving construction and plant with mobile phones but I suspect there will be some in due course. Banning the use of mobiles on site is difficult when it could be a work related phone call and supervisors use them regularly. That said, anyone using a phone and operating plant would be a no, no. Some sites I believe have a designated mobile phone area in a place of safety.

Thanks gents , we have the usual rules no operating plant whilst using a mobile phone and we also provide a safe area for people to take and make calls I was just looking for a more direct way of getting the message across to the workforce

The one and one only way of getting a message across in all situations is to talk directly to staff and obtain immediate feed back as to their understanding and acceptance of a situation. I would use the task talk/tool box talk process, getting staff to sign that they have had the talk and understand the situation thereafter I would discipline any supervisor who was not managing their area properly

Thanks Tec boy I use the DVD on the cost of accidents but was looking for more new material to use
to refresh the message
Bob I would prefer to change attitudes and behaviour of supervisors as going down the disciplinary procedure will only affect the moral of the workforce .And if the supervisor was removed the problem will only move on with the supervisor change is better than beating people with a big stick, well that’s my thought
it would be good to get other peoples insight into this and what they do
Thanks
Chris
