If you are contracted to a company through an agency, who should supply the PPE the company or the agency you actually work for?, advise please

our works manager when recruiting cover from agencies states that they should arrive for work ,with high vis ,safety footwear
no ppe no work, one guy arrived no boots i sent him home ! simple communication between us and the agency at the outset.

Depends on the contractual arrangement between employer and agency. Not uncommon to be a bit of both.

Hi, We have 41 contractor companies working on site, our contractual agreement states they are responsible for providing PPE which meets our approved standards.
It really comes down to what is put in the contract when the company is engaged to work on the site. We assist them with purchasing on occasions to reduce the financial burden on some of the smaller companies, however it remains their responsibility. If any of my safety team observe PPE violations, we return the contractor to their office, and ensure the corrcet PPE is issued. NO PPE results in removal from site.

According to the HSWA it is the employers' responsibility to provide PPE and incidently, training in its' use.
This means that if the employer is an agency then that is who is responsible for provision. If the site wishes to take on this responsibility that's fine but the ultimate responsibility still resides with the employer. Another point is that a fair number of agency workers are in fact self employed, operating as limited liability companies and therefore it becomes their own responsibility.
As has been suggested though, a no ppe+no work rule usually sorts it out.

This has been debated here many, many times, including fairly recently. A search might be worthwhile. There is no clear guidance but I would suggest as Claire that it is best to clarify and agree who does what during your contractual negotiations. Be aware, that the employer for health and safety purposes might not be the same as the employer for PAYE purposes I.e. don't assume that the agency is 'automatically' responsible for PPE.
