Quite an interesting history of posts... all seeking help with...
So when I was asked a similar question when I mentioned the new sentencing guidelines I downloaded the document and picked out the matters most relevant for my audience (business size, potential outcomes and culpability based on the current position). Did help that Merlin had decided to plead guilty over the Alton Towers crash so I was able to put a hypothetical outcome which we await the September sentencing to confirm

Don't worry as I've found it via google but am surprised that there isn't an obvious link from this website.
Also, the ridiculous re-posting restriction is frustrating....first I'm told that I can't repost for "7 seconds" then second attempt "21 seconds"!!!

Hi all. Can I suggest that when talking about the increase in fines resulting from the new Sentencing Guidelines that you also include a) the prosecutions investigation (FFI) and defence costs and defence legal costs, which together generally exceed the level of the fine, particularly where the HSE and defendant are represented at any Inquest. While defence costs are often covered by insurance, the organisation's premiums will rise (generally to allow the insurer to recover its costs within 5 years).
In general, the premiums do not return to their pre-incident position due to the increased risk the organisation poses. Finally, don't forget the victim surcharge that is imposed by the courts in criminal/regulatory cases.
I have just finished a case where a £300,000 fine was imposed and costs (defence and prosecution) exceeded £500,000. Dealing with fines alone only gives part of the story.
