If the construction firms have a proper system in place the HSE would not find anything wrong. Bring it on! - it might drive a few cowboys to the wall and level the playing field a bit.

I also don't see the issue, unless the HSE are being overly pedantic about things. You can almost anywhere find a minor material breach (or at least something wide open to interpretation). Did any of us expect the recovered costs to ever go down ? Get everyone used to the idea, then ramp up the new revenue stream.

It's a funny thing...when FFI was first mooted on this forum the general consensus was how amoral it was, conflict of interest, only large companies will be hit, employees and consultants will be in a vulnerable position, etc. Now it's a case of 'the offender pays' and it's the best thing since sliced bread!
