In my experience ( My main role is to ensure my company's equipment complies to relevant EEC regulations), this is very widespread.
With few exceptions, applying the CE mark is based on in-house opinion. The less competent that opinion is, the easier it is to apply a pass. Chances are, no one will ever argue.
Being a cynical old s*d, you always get what you pay for: if the item is much cheaper than the competition - well you know what to expect.
The playing field is far from level.
I would suggest to any H&S advisor to ignore the CE mark and check out new purchases for themselves. If it is expensive or complex then get a specialist in.
I saw not many months ago a CNC machine tool (made in Italy) that had a list of basic guarding failures as long as your arm. Most of which would have been illegal in the old Factories Act days.
The buyer beware and all that.
