Hi, I would appreciate feedback from members on the following 2 questions please:

1. Who has the responsibility for providing the "as built drawings" for the H&S file on completion of a construction project where there is no mention of it in the contract? Should the client arrange these from the project architect or is it the responsibility of the Principal Contractor to provide these under CDM Regs 2007?

2. Is there a requirement for building manuals AND a H&S file to be provided or should the contents of building manuals be incorporated in the H&S file?

scobo9, you need to get your contract terms sorted out to avoid this in future.
CDM Regs give pointers, but nothing hard and fast if you are in dispute.
I would suggest that (strictly speaking) O&M manuals are outwith CDM.
You also need to be clear what your expectation of an "as built" drawing looks like. Is a marked-up copy good enough? Overly strict contract terms requesting CAD drawings from general trades building contractors are asking for the impossible. The retention sum is seldom significant enough to prevent the contractor walking away from what he always saw as an unfeasible requirement.
On complex projects, keep the entire project team close to the construction phase when you can that allows the designers and technicians to keep drawings up to speed.
Additionally, sometimes the CDM waits until the end of the project to request info for the File which he should have been gathering as the project progressed, and that marked-up copy of the M&E installation has been lost in the interim.
