Belgium Health & Safety requirements - Internal H&S?

Hi, help is required please .........
Are you able to answer these questions for me please.
1. I work for Sony Europe and Sony Belgium is a subsidiary of Sony Europe. Can the Health & Safety internal person(s) work for Sony Europe and have responsibility as the named person for Sony Belgium
2. What is the minimum H&S qualification for the internal H&S support if there are Sony European Policies and Procedures across the entire Sony European portfolio.
3. Or: can our outsourced Facilities Management Company provide the services by delegation by the Managing Director for Health & Safety on the Belgium Site?
Is there something that I'm missing?

Hi Carol I am not really sure what the question is i.e. what is the problem.
Most international companies I have dealt with, have a structure which meets the 'best' requirements or highest standard requried regardless of where the people come from. There is always an issue of local details which need to be met but as long as you have robustly defined the parameters and the people invovled are accredited to the level of competence needed then this should meet the criteria.
If you are travelling or advising across Europe you may want to extend your IOSH qualiifcation and be registered with the pan European Safety group (whose name has just escaped me. Check on the EuOSHA site)

Hi Sheryl,
the problem is that the local H&S person in Belgium with the level 2 qualification is leaving the company.
In Belgium the `Internal Prevention Officer` has to have a contract of employment with the Company. What I'm trying to confirm is due to the fact that Sony Belgium is a Division of Sony Europe would the contract of employment with Sony Europe cover the criteria for Belgium H&S Law.
If any one knows this I would be very grateful as I've researched and emailed all th relevant bodies in Belgium, who eiher don't know or do not respond.........

Belgium has, as I am sure you are aware, some very protective and complicated labour laws all interwoven with collective agreements. So not an easy question to answer. It is more employment law than H&S and it would (in the first instance) be unlikely that all term of the employment contract will meet the strict guidelines, but if you can match it to each point then you are on a winner...
