Good evening,

I noticed the sentence below whilst reviewing a procedure:

There is a requirement to report the subsequent death of an employee who dies as a result of a reportable injury within one year of the incident.

I'm struggling to find anything that confirms this, so thought I'd see if anyone could advise.

It is in RIDDOR 2013.-- Work-related fatalities 6.—(1) Where any person dies as a result of a work-related accident, the responsible person must follow the reporting procedure. (2) Where any person dies as a result of occupational exposure to a biological agent, the responsible person must follow the reporting procedure. (3) Where an employee has suffered an injury reportable under regulation 4 which is a cause of his death within one year of the date of the accident, the employer must notify the relevant enforcing authority of the death in an approved manner without delay, whether or not the injury has been reported under regulation 4.

“There is a requirement to report the subsequent death of an employee who dies as a result of a reportable injury within one year of the incident.” , is wrong, because it implies that you can wait for upto a year before reporting a workplace fatality. If someone dies at work due to an injury you must report it as soon as possible.  If they die upto a year  AFTER the incident has taken place, as a result of  THAT incident,  then you must report it is a soon as possible.

I wouldn't go so far as to so say it's wrong, because it could be read either way.  That is of course a problem in itself.   I think such an ambiguously worded procedure could do with rewriting for clarity.
